Abstract: It is obvious to all who work in the alternative dispute resolution (ADR) field that the most important federal statute — the Federal Arbitration Act (FAA) — does not define its key term: “arbitration.” A recent case, Advanced Bodycare v Thione, invited the 11th Circuit to explore which types of ADR processes are considered “arbitration” for purpose of the FAA. Under the 11th Circuit’s narrow test, an agreement to mediate, as well as an agreement to mediate or arbitrate, falls outside of the scope of the FAA. There is a fundamental distinction between an ADR agreement that allows parties to either mediate or arbitrate disputes, and a classic med-arb agreement, which calls for mediation as a condition precedent to binding arbitration. While a med-arb agreement was not before the 11th Circuit in Thione, the authors caution against applying that court’s reasoning to med-arb agreements..

What issues and concerns has the work of The Dancing Wheels and Ai Weiwei brought to the public consciousness?

We will spend the next two modules looking at how humans communicate. The ways are so many and varied, both conscious and unconscious, that it is helpful if we break these down into two discussions. In this first discussion we will look at the fine and performing arts as vehicles through which people can communicate complex ideas. The arts communicate directly, without the limitations of language, and often strive to make an emotional impact on an audience.

In this discussion you are asked to consider art as a vehicle that raises awareness by communicating concerns and needs of others in communities and groups around the world by exploring the life and work of the Chinese artist Ai Weiwei. He is world famous and has paid an enormous personal price for giving voice to the social justice issues that people in China face. The arts can be a powerful tool to convey these concerns and raise awareness across communities and around the world.

The inclusion of individuals with disabilities, both in schools and  in the community, has changed significantly over the last 100 years.  This has been influenced by a variety of events, court cases, and laws.  It is important for special education teachers to be aware of what has  instigated these changes. In addition, special education teachers need  to be knowledgeable of the laws that are related to special education  and how they will affect service delivery to special education students.

Part 1: Timeline

Create  a timeline of the history of special education from the late 1800s to  the current year. Include 10-12 major events, laws, and court cases  that, in your opinion, have influenced special education. Provide a  25-50 word description of each factor in the timeline and a rationale  for your selection.

Part 2: Summary 

In  250-500 words summarize the changes in special education portrayed in  the timeline. Emphasize the two key special education laws, the  Americans with Disabilities Act (ADA) and the Individuals with  Disabilities Education Act (IDEA). Discuss how each has influenced the  inclusion of individuals with disabilities in the educational setting.

In  addition, reflect upon how knowledge of special education history will  affect ethical decisions in your future professional practice.
