Legal Aspects of Doing Business Discussion

Step 1: The Story

You may either create a story of your own or borrow a story from case law, journal article, book, fable,

nursery rhyme, scene in a movie, etc. … .

The Story should be about 3-5 paragraphs and must be about a person or persons suffering a loss to

property, a physical and/or psychological loss and who consider themselves entitled under law to

compensation from one or more other persons.

Step 2: You are the judge.

By: (a) setting out; and (b) applying the legal test for negligence, as set down by the Supreme Court of

Canada in the Mustapha case, decide who should be the successful party in your story, who should be

held responsible, is it one or more people, and by how much. In other words, the amount of damages to

be awarded by you, if any, to the plaintiff for their loss.
