International Business Transactions and the Doctrines of Sovereign Immunity and Act of State.

Need help with my writing homework on International Business Transactions and the Doctrines of Sovereign Immunity and Act of State. Write a 2250 word paper answering; Foreign business entities seek to take advantage of the host country by exploiting the host state’s capacity for lowest production cost, highest sales turnover and repatriating their profits to their respective home states whilst the host state aim to make the most of the foreign entities’ operations in its territory to benefit its economy and resist, as far as practicable, repatriation of profits. 2 Even the advent of globalisation and free trade, states remain possessed, although diluted, of inherent powers under legal principles and doctrines that can pose as sources of political risks and instability for international business transactions. These legal principles and doctrines, that transcend national boundaries, are underpinned by the right of the state to protect itself and its citizens.

The ability to anticipate and manage risks and potential conflicts are crucial in the management of international business transactions and economic success largely depends on it. Albeit good contractual planning significantly minimises these potential risks and inevitable conflicts, it is never absolute security from future risks. This is because contract planning is always encumbered by future uncertainties posed not only by economic but, also political and legal changes, such as war, revolution, civil unrest, nationalisation and government acts that can greatly affect the conduct of business.

One of the legal precepts that international business entities must contend with is the principle of state sovereignty. This principle provides that a state has a right to self-determination and thus, has exclusive control over its territory, property ownership and economy. It is synonymous to state independence allowing the state to fully exert its power, authority, order and legitimacy without being subjected to a higher or external power. As can be gleaned from such a description of the precept, state sovereignty has two aspects: internal and external. The first refers to a state’s ultimate dominion over the fate of its&nbsp.territory and everything within it and is also called political sovereignty whilst the second, also called juridical sovereignty, refers to its equal standing with other states in the global stage.

Your assignment is to prepare and submit a paper on cultural diverse backgrounds 3. I can say that my mother raised us influenced by seven of the listed factors and not so much by one which is the beliefs about parent’s roles. My father left us 20 years ago and my mom had to fill in both parents’ roles in my family. My mother’s role models for parenting were her parents, still together after so many years. Nevertheless, she did not have any illusions about how a single mother should be. She was readily a father when we needed one. With our financial situation, my mother taught us the value of money and hard-work. She showed us how diligence and responsibility pay off in the end. As a result of working together in our home, my mother had taught my siblings and me the value of family. Until now, we have a close relationship to each other and to our mother.

As I remember, my mother treated my older brother, sister and I similarly and yet differently as well. It was dependent on our varied temperament and behavior. Being the only girl, my sister was shy so my mother was more soft-spoken and more gentle when scolding her. She was harder on my brother and I because we were more stubborn and naughtier than my sister.

My grandparents were from Ireland and had to learn English. This difficulty in culture was one my mother did not want us to deal with. At an early age, she taught us English and yet never failed to remind us of our Irish heritage.

Influence from religious beliefs was strong. My mother is Catholic and so are we. I remember mother teaching us to pray before meals and before we went to sleep. She would take us to church and remind us that God is good and we could ask Him for help but should also thank Him for our graces.

Finally, my mother believed that children learn from their mistakes. So, she let us be hurt growing up. She was there to console us though and explain why we were hurting and how to deal with our problems. She let us solve our own problems but was ready to help if we asked her.

During the development of a project change proposal, many considerations must be taken into account. These considerations may include financial, quality, and clinical information, that should be thought of. When creating a change proposal, a major hurdle can be related to the financial aspect of implementation or creation. The proposal will take potentially a large amount of labor induced costs, in addition to the cost of supplies. Many changes are welcome in healthcare because they can improve care quality and save costs (Al-Abri, 2007).  This can work against the proposal if it is not within the budget. However, the change can result in overall cost savings for the healthcare system if implemented. If my communication change is implemented it can result in a potential savings for the hospital as it can result in a lower length of stay, increased safety, and increased patient satisfaction. Quality in healthcare is also an important aspect as it directly effects the patient care and outcome. If the quality of communication is good the continuity of care will be good, and the care will be better than if there was a loss of communication. This in turn directly affects the clinical aspects of care. Without necessary communication care will be poor. If the plan is implemented the communication will improve, and patient care should be better compared to before.
