Mediation

Suppose that you are the HR manager for a company. The judge in a current law suit by a former employee has ordered mandatory pre-suit mediation. Your boss is unfamiliar with mediation and she asks you to advise her as to several issues regarding the upcoming mediation. Draft a memo thoroughly discussing, at minimum, the following questions: 1. What are the advantages and disadvantages of mediation? Is it likely to be successful? Is it likely to make the parties more or less hostile toward one another? How do the costs in terms of time and money compare with litigation?2. If your boss has no interest in mediation, does she really have to be there? Can she send her attorney instead? If so, are there any conflicts of interest with respect to attorney advocate representation of which she should be aware?3. Must the company actually participate in the mediation? Can your boss (or her attorney) just sit there and refuse to speak?4. If your boss (or her attorney) does decide to engage in dialogue during the mediation, what are the risks concerning information that might be disclosed? If the mediation fails, can the former employee use such information at trial?

Submission Instructions:

This assignment should at a minimum contain 1,000 words of content (there are four parts, so this is ~250 words each). Word count does not include headings, cover pages, references, or question text (if you choose to include it in your paper); I am looking for 1,000 words of substance. Your paper should be in APA format including a properly formatted cover page (abstracts are optional) and a reference page with at least three (3) NEW references (“new” here means references that you have not already used in previous assignments in this course). Providing additional references to your assignments demonstrates your desire to conduct additional research on the topic area, and can improve your research skills.

Reflection Paper, Assignment #1

Religion, the Spiritual Journey, and the Five Stages of the Soul

Instructions: These reflection papers are a chance for you to think through and relate to the assigned readings in your own way.  Think of this paper as a kind of “journal” in which you reflect on the ideas in the readings. The study and practice of religion is a highly personal experience and each person comes to the Qur’an, the Bible, the Bhagavad-Gita or any other religious text in his or her own way.  Therefore, you are encouraged to be creative and to write about your own personal experiences, relating them to the faith practices and wisdom traditions we will be studying this semester.  However, be aware that creativity and chaos are not synonymous—in other words, you need to make sure the ideas and thoughts expressed in your paper are coherent and understandable, and most importantly, that they directly relate to the readings.  Essays must be typed in 12-point font and should be 500 words in length.  When you cite a source, be sure to include the title of the book and page number.  If you cite a source other than our class textbooks, include a bibliography at the end of the paper.

Some of you may be very familiar with one particular religion we are discussing this semester.  If this applies to you, try (if only for the short period of weeks we are in this class together) to look at your own religion with “new eyes.”  For example, if you are a Christian, try to consider how a Buddhist might see your religion.  If you an Atheist, try considering life from a Muslim’s perspective. Don’t be afraid to experiment with ideas.

Prompt: (Please address/reflect on ALL questions from both sections in your essay)

1.)    Drawing on Young’s discussion in chapter 1 of The World’s Religions, discuss how religion has been understood and described.  How would you define or describe religion or the sacred?  Consider yourself a religious person, what aspects of ISLAM hold the most meaning for you?  Why?

2.)    Consider the story “The Hymn of the Pearl,” cited by Moody in The Five Stages of the Soul (p. 59).  Why does he tell this story?  What does this story suggest about the human being’s tendency to forget his or her divine nature?  How does the story relate to the stage of the Call?  Do you identify with this story?  Have you ever experienced what Moody refers to as “the Call?”  Please explain.

One of the trends marking the continuing transformation of the U.S.  health care industry is the dramatic increase in the pace of  competition. The heightened competition is taking place among hospitals,  health plans, physician groups, and drug companies, and between  physicians and hospitals, and hospitals and health plans. Listen to the  Looking Ahead: The Future of Health Care Policy podcast from National  Public Radio (NPR). Then, prepare a three- to five-page paper in which  you:

  • Describe the different forms of competition that take place among various types of health care organizations.
  • Evaluate the benefits and pitfalls of competition in health care and  suggest alternatives if competition was not the primary driver of  operations in the U.S. health care system.
  • Explain the elements of successful competition and the use of competitive intelligence.
  • Describe the influence competition has on the services offered by health care organizations and the choices patients have.

Your paper must be at least three double-spaced pages (excluding title  and reference pages) and formatted according to APA style as outlined  in the Ashford Writing Center. Utilize a minimum of two scholarly  sources that were published within the last five years. One source must  be obtained from the Ashford University Library and focus on competition  health care. All sources must be documented in APA style as outlined in  the Ashford Writing Center.

Reflect: For this discussion, you will be creating your Personal Learning Profile (PLP). As Dr. Johnston said in the video, you want to be able to frame your description so that someone can get to know you quickly and completely. More importantly, your PLP helps you articulate how your mind works and how that causes you to feel and act in everyday life. Review Section 2.7 from Chapter 2 which describes the process of developing descriptions for your profile.

  • For each Learning Pattern (Sequence, Precision, Technical Reasoning, and Confluence), write a paragraph of four to five sentences describing how you use the Pattern in your daily life. This may include examples or your thoughts, feelings, and actions as they relate to each Pattern.
