Scenario

In June of 2016, you begin your first week as an intern at the Happy Town Police Department. As an intern, you develop a good rapport with Police Chief Rodney Hurt. On the second week of your internship you begin to ask questions (of the police officers you have been working with at the department) concerning the Uniform Crime Rate. You tell them you are taking a class at Strayer University and are interested in gaining a better understanding of statistics and the application of statistics to law enforcement. The following day you are greeted by Sergeant Gunn. She provides you with Part I crime data over the past five years that were submitted to the Federal Bureau of Investigation for the Uniform Crime Report. The Part I information provided to you by Sergeant Gunn is a compilation of crime data drawn from four areas: Happy Town, Frown Town, Smooth Town, and Cool Town. After a review of the crime trends, you are alarmed at the rate of crime reported in these four towns. You are now curious to dig a little deeper and make some comparisons across the data provided to you.

Task

Your task is to write a report for the Chief of Police Rodney Hurt. He will use the report for his news conference regarding to the public’s concern for the increase in crime over the past five years.

In the report, you will include the following:

1. A definition and description of the Uniform Crime Report.

2. A description of the data-gathering strategy for your report and a rationale for why you chose this technique.

3. A discussion of the crime trends comparing Happy Town, Frown Town, Smooth Town, and Cool Town over the past five years.

Your report should clearly describe all the details necessary for the Chief’s news conference. Your answers will be judged not only on the accuracy of the information you provide, but also on how thoroughly the information is covered, how effectively the report is organized, and how well your writing reflects the conventions of standard written English. While your personal values and experiences are important, please answer all the questions in this task solely on the basis of the information provided in the Document Library.

The following case study presents issues related to the steps a criminal defendant may go through in the American criminal justice system from arrest through sentencing.

Case Study:

You have just been hired as a lawyer at a small criminal defense firm. On your first day, Louis Steele enters the office and asks to speak to an attorney. All of the other lawyers are at lunch so you speak to Mr. Steele. Mr. Steele states that he is worried about being arrested for an armed robbery of a gas station that occurred the night before. Mr. Steele explains the following to you after you assure him that anything he tells you will be protected under the attorney-client privilege.

Mr. Steele states that he has been out of work and owes money for gambling debts; that he was desperate for money and robbed a gas station last night located a couple of blocks from his house. Mr. Steele states that he used a BB gun but admits that it looks like a real gun. Mr. Steele took a total of $130.00 during the robbery. Mr. Steele states that he was not wearing a mask and that the attendant got a good look at his face. This morning, Mr. Steele heard that officers had stopped by his apartment looking for him. Mr. Steele tells you that the only person at the apartment this morning was his 13-year-old nephew. Mr. Steele did not know whether the 13-year-old let the police in or if the police forced themselves in, but states that the police found the BB gun he used under Mr. Steele’s bed. Mr. Steele wants to know what is going to happen to him should he be arrested — from arrest to sentencing. Mr. Steele has no experience with the criminal justice system and has never been arrested before.

Please prepare a PowerPoint presentation as follows:

  • Include 10 substantive slides and a maximum of 15 substantive slides, not including cover slide, legal term slide(s) or reference slide(s).
  • As Mr. Steele’s lawyer, explain the advice you will give him both pre-arrest and post-arrest.
  • Identify all major steps you will take to prepare a defense for Mr. Steele , including investigation of evidence and witnesses, should Mr. Steele be arrested for a felony such as armed robbery.
  • Explain to Mr. Steele the pre-trial process and any motions you would file on his behalf (including your reasoning for filing these motions).
  • Describe to Mr. Steele his trial options.
  • If this case goes to trial, discuss with Mr. Steele the possible sentence he could face based upon a review of your own state’s criminal laws.
  • Define key legal terms to Mr. Steele so he has an understanding of the legal principles involved.
  • Cite all legal authority used in giving advice to Mr. Steele.

JUSTIFICATIONS AS DEFENSES

Part 1

Research the case of Tennessee v. Garner, 471 U.S. 1 (1985).  Provide the factual background of the case, the procedural history, and the issues and analysis confronted by the court in dealing with the issue of when a law enforcement officer may use deadly force.  Are the guidelines set by the court clear, or do they provide a less than bright-line standard that a law enforcement officer must decide upon in a split second?

1.    Insanity Defense

A local business owner has been arrested for the nonfatal shooting of a competitor, who he said taunted him and destroyed his business reputation. The defendant is from a culture in which people who commit social wrongs make public apologies; in some cases, they commit suicide to show remorse. The defendant stated that his competitor slandered him to vendors and to customers. In addition, he refused to apologize when confronted and only laughed at the defendant. The defendant said that he was “out of his mind” with rage when he pulled the trigger. Answer the following questions:

a.         Can the defendant use any affirmative defenses? Why, or why not?

b.         Should the defendant be charged with any crime? Why, or why not? What crime?

2.   Self-Defense

You are a police detective investigating a homicide case in which the defendant shot and killed a man who had broken into her apartment and threatened to rape her. He was eight inches taller and 60 pounds heavier than she is, and she stated that she feared for her life. Answer the following questions:

a.         In such a case, is lethal force justified for self-defense? Why, or why not?

b.         What other factors would you consider in a case such as this?
