You are a legal assistant working with a criminal defense attorney on a homicide case. At the defense team’s strategy meeting the lead attorney points out that there is a disturbing amount of physical evidence linking your client to the murder and if this evidence is fully presented to the jury there is a strong likelihood that you will lose the case and your client will be convicted. However, there is also evidence that the police conducted searches of your client’s vehicle and residence in violation of his constitutional rights.

Your boss intends to focus on preventing the introduction of this evidence and you have been given the responsibility of researching the possibility of your team successfully doing so.

Using the excellent Criminal Evidence: Principles and Cases textbook ed 9 and at least four other sources, put together a paper addressing the following:

1. Discuss the exclusionary rule and how it might benefit your client?

2. How might the fruit of “the fruit of the poisonous tree” apply to the benefit of your client in this scenario?

3. If the judge denies your request to exclude evidence using both the exclusionary rule and the fruit of the poisonous tree doctrine, how else might the admissibility of this evidence be challenged by your defense team?

4. If the evidence is excluded using the exclusionary rule are there still potential avenues the prosecution may use to admit this evidence under certain situations?

5. If you are successful in excluding evidence does that mean the case will necessarily be dismissed? Explain.

Current And Future Challenges And Technology

With the recent spate of police shootings in the United States, there has been an uproar regarding police discrimination against the black community. Technology has played a large role in these events, making the job of a police officer even more challenging. This same technology has the opportunity to improve policing policies across the country, especially when it comes to managing and building community relations.

Imagine a scenario where your department is considering using body cameras and social media as part of a digital dive initiative to build community relations. You have been asked to provide your observations on the future challenges in the field of policing and how the implementation of these technologies can contribute to building safer communities.

Write a 700- to 1,050-word white paper for your department. According to the Purdue Online Writing Lab, “…the purpose of a white paper is to advocate that a certain position is the best way to go or that a certain solution is best for a particular problem.” In this case, your white paper is meant to help your police department better understand the issues and opportunities around technology, including the use of body cameras and social media.

Problem Statement: Provides examples of previous incidents where the lack of social media platforms, body cameras, and other technology impacted crime control and community relations.

Main Body of the Paper: You will support your thesis in this segment. With citations and analysis backed by clear reasoning and arguments, this part is usually the longest section of your paper.

Several weeks later, her lover breaks into Amy’s house and shoots and kills her husband. He takes a few valuables from the house to make it look like a burglary.
  5. You and your partner are dispatched to a domestic dispute. When you arrive, you hear loud voices inside the house. You knock on the door and announce that you are with the police department. A small-framed male answers the door. You advise him that you’ve received a call about a domestic dispute. You notice that the man has a small amount of blood dripping from his lower lip, which also appears to be bruised. You ask the man if he is okay or in need of medical attention. He advises you that he and his “roommate” have had a little fight that “got out of hand.” A larger male is standing in the kitchen and he seems irritated that you are there. He speaks up and says “We were arguing and I lost my temper a little.” The smaller male advises you that he does not need medical attention and that he does not want to press charges.
