Inmate abuse, corruption, violence, and inmate deaths have been reported throughout the last decade. Now, imagine you observe this incident as a training officer in a jail in the United States. An inmate with mentally illness died after being left in an overheated cell. Since the closure of many mental health institutions, jails are housing a large population of inmates with mental illness.

In many jails and prisons, the sanitary conditions are inhumane, with raw sewage spilling out of the toilets. Officers handed out diluted detergent to the inmates to reduce the smell. An inexperienced officer gave the full packets to the inmates. One inmate swallowed the detergent, resulting in extreme pain and bleeding from the mouth for hours. The officer reported the incident to the captain, who did not want to be bothered with the incident unless the inmate is dead. Despite the warning, the officer reported again to the captain twice, requesting medical assistance for the inmate. The inmate died the next morning.

After an internal and criminal investigation, the captain was demoted and arrested by the FBI and prosecuted for violating the civil rights of Mr. Echevarria, who was sentenced to 5 years in prison. The officer was fired and filed a wrongful-termination suit disputing the captain’s claim that he was never told about the inmate’s health crises.

Evaluate the incident and create a memorandum for the officers at the jail reminding them of their ethical duties.

  • Identify the theories of ethics the officer and the captain violated.
  • Develop an action plan to promote ethical behavior by officers and evaluate current research on programs improving ethics among law enforcement officers.
  • Indicate the resistance you expect to the new plan, and then explain how you would overcome it.
  • Determine if it is ethical to house inmates with mentally illness in jail.

Therapy in Correctional Settings: Can I Leave?

 

Dr. Bernadette Jackson is a correctional psychologist and treats patients at the state

correctional facility using group and individual therapy. Dr. Jackson is treating Andy K., an

inmate with an Axis I diagnosis of depression and an Axis II diagnosis of Antisocial

Personality Disorder. Andy was sentenced to ten years in prison for strong-arm robbery. He

has served six and one-half years and goes before the parole board in six months for the

possibility of early conditional-release.

 

Andy requested individual psychotherapy sessions approximately three months ago with a

presenting complaint of symptoms related to depression. Andy attributes his depression to

news that his estranged mother has been diagnosed with stage-four cancer and has been

told by her doctors that she has approximately one year left to live. In therapy, Andy

expresses his desire to make amends with his mother and indicates his desire to care for

her during her final days.

 

During a therapy session, Andy mentions that he has private information from inmate

Zackman regarding a previous sexual offense. Inmate Zackman was sentenced to three

years on a drug-related charge. However, Andy reports that Zackman bragged about a child

abduction which has never been solved.

 

The warden has requested that Dr. Jackson prepare a report on Andy’s progress in therapy

and offer a prediction regarding his risk to re-offend for Andy’s upcoming parole hearing.

Case Study

As a sergeant on the Cityburgh Police Department, you have received your rookie partner’s report on three cases. In addition to the facts presented in W1 Assignment 3, you are given additional information regarding each case. Your job is to look at the new facts and determine whether any further crimes have been committed and whether the suspects have any defenses to the charges. You are to present a 2- to 3-page analysis of the situations to your captain and the district attorney.

For all three cases, be sure to focus your responses on the elements of the possible crimes, the elements of the possible defense, and the facts of the case. If more information is needed, be sure to indicate all possible outcomes.

Case 1—Able

Last Thursday, Able was stopped for a traffic violation. During the stop, the officer ordered Able out of the car and performed a frisk of Able’s person. During this frisk, the officer noticed a large object in Able’s pocket. Able was asked to remove the object and complied. It was determined that the object was a plastic baggie of methamphetamine crystals— possession of controlled substances (see Code of Virginia § 18.2-250). Able claims that he thought that the officer was trying to buy some of the drugs from him.

Case 2—Baker

Officers Young and Zerr responded to the report filed by Baker’s neighbor by questioning Baker at his home. Upon arrival, Officer Young noticed several nonoperational vehicles parked in the yard, both along the road and near several buildings. Officer Young took down the Vehicle Identification Numbers (VINs) of the vehicles, whereas Officer Zerr went to the house. The VINs were found to match several stolen vehicles, and Officer Young then entered the outbuildings to look for more stolen property, which was found (see grand larceny, under Code of Virginia § 18.2-95).

Meanwhile, Officer Zerr approached the house and knocked on the door. The door was answered by Baker’s seven-year-old-son, Baker Jr. He was armed with a shotgun, which he aimed at Officer Zerr and told him to leave the property (see assault and battery, under Code of Virginia § 18.2-57). Both officers left and later spoke with Baker by phone. Baker claims that he found all the vehicles abandoned and was told by the former sheriff’s deputy that he could scrap them if he towed them away.

Case 3—Charlie

Charlie was found sleeping on a park bench and brought to the station. He was released after processing but did not have transportation to return to his vehicle. An officer gave him a ride back as he was not familiar with the area he had left his car in. The officer checked the vehicle’s license plate in his computer for outstanding tickets or other violations and, while waiting for the report to come back, told Charlie to pop the trunk. Inside the trunk, the officer found two garbage bags containing human body parts and a bloody axe (see murder and manslaughter, under Code of Virginia § 18.2-30). However, Charlie claims not to remember anything that happened the night before.
