So, basically our instinct gets its guideline from our submissive feelings.

The question demands here, should we discard explanations that are intuitively appealing? Before giving concluding remarks we have to view the subject in the light of other knowledge-related issues like science. First take this example of my own:&nbsp.I used to eat an excessive amount of chocolates on a daily basis, I am just obsessed with it. apart from the fact that it contains considerable amount of fat. But because I wanted to be able to justify my habit of eating chocolates in such large quantities, I did some research on the benefits which chocolate offers and found that it contains certain amount of chemicals like tryptophan, phenyl ethylamine and theobromine, that are good for the human brain and that, its consumption give some extra benefits to the human body, mind and spirit (Duke and Yeager 26). These facts illustrate that it has some good nutrition elements in it that are find effective for the mind due to its ability of reducing tension. Thus, it formed the basis of an intuitively appealing explanation that would help me justify my obsession. Although these facts may have been proven, but those small percentages did not actually prove that it constitute a healthy eating habit. Without a doubt, the fact that it was made of more than half fat and sugar proved the exact opposite. So was I still able to accept my intuitively appealing explanation?

The main idea of this example was to show that intuitively appealing explanations that are false, with obvious evidence against it, should be discarded. So, we get a new idea here: we are talking about those explanations that are not definitely wrong and which are appealing to our intuition.

write an article on the differences between australian contract law and brazilian contract law Paper must be at least 1750 words.

Hi, I am looking for someone to write an article on the differences between australian contract law and brazilian contract law Paper must be at least 1750 words. Please, no plagiarized work! While Brazilian law, like Australian law, indorses the duty to act in good faith and honesty with respect to contractual relations, the doctrine of freedom of contract under Brazilian law is subject to constraints.3 The new Brazilian Civil Code 2003, mandates that the freedom of contract shall be based on and constrained by the “social function of the contract”.4 As Grebela explains:

For the purposes of the formation of a contract, Brazilian contract law is at odds with the position taken in Australia. For instance, an offer made to multiple persons, such as those made in advertisements is generally considered to be an invitation to treat under Australian contract law unless the contrary is derived from the nature of the offer.6 Ultimately, goods placed on display with price tags attached are not offers but actually invitations to negotiate offers and do not become an offer to enter into contractual relations until such time as an item is selected and presented for purchase.7

Under the Brazilian Civil Code, the opposite position is true. By virtue of Article 429 of the Civil Code 2003 (Brazil) any offer made to multiple parties will be deemed to be a contract proposal if the offer contains the essential elements of the actual contract.8 In other words, the general rule under Australian law is that an offer made to the public is no more than an invitation to treat unless it clearly intends to form the basis of an offer. Under Brazilian contract law, the offer made to the public at large is a contract proposal/offer unless it is clearly meant to be a mere invitation to treat.

Under Australian contract law, when the time for performance of the parties’ respective obligations is fixed under a contract, the parties may extend that time by agreement, acquiescence or waiver.

&nbsp. In a typical case, the courts tend to encourage the continuation of a contract and will not treat delay as a fundamental breach if it is possible for the parties to comply with the contractual terms despite the delay and default by one of the parties.

First, the idea is to structure the company along product lines instead of the current structure where each of the verticals would have a separate department instead of along functional lines. The current division is based on functional lines wherein the sales department is separate and the insurance department is separate. The current structure lends itself to unnecessary redundancy and according to the theory (Miles, 1978), division along product lines is any day better than division along functional lines. If the company adopts this method, the divisions would be along verticals instead of the horizontal division currently in place.

This movement towards product lines is appropriate because the people in one product line would be motivated more to perform and function rather than people in different functions working separately. This makes eminent business sense as the people in different departments that are currently existing can get together and plan for their sales and marketing strategies as a means of achieving their targets. The appropriate theories of leadership that can be applied here are Theory X and Theory Y which state that a leader can apply these two competing visions of leadership to get the work done (Mullins, 2008).

As part of the division of the company along vertical product lines, it is necessary to structure the company in such a way that the board members are also structured along with the product line strategy and that they operate within the structures prescribed in this management report. This division of the company along product lines makes for eminent business sense and hence they can work for the betterment of the company.

According to&nbsp.Maslow’s theory of Motivation, people respond to a variety of inducements ranging from simple monetary benefits to comprehensive and visionary motivations arising out of altruistic motives (Torrington, 2002). This theory holds that once the people are sufficiently empowered to be motivated by these inducements, then the level of performance that they can deliver goes up correspondingly.
