For the incarcerated population in the United States, health care is a constitutionally guaranteed right under the provisions of the eight amendment which is the prohibition against cruel and unusual punishment (see Estelle v. Gamble). This particular prison can hold in excess of 1,728 offenders and routinely houses between 1,600 and 1,700 women on any given day. This institution incarcerates all custody classes to include minimum security, medium security, close custody, death row, and pretrial detainees. 

The health care operation provides the highest level of care for the female offender in the state. The health care facility is a 101 thousand square foot, 150 bed, three-story building that cost the taxpayers $50 million dollars to construct and is a hybrid of an ambulatory care center, long-term care center, and a behavioral care center. The health care facility also houses an assisted living dorm.

The patient demographic includes women who have multiple co-morbidities including substance abuse, seriously persistent mental illnesses (SPMI), diabetes, cardiovascular disease, cancer, morbid obesity, HIV / AIDs, hepatitis, etc. On any given day there will also be 30 to 60 offenders who are pregnant, with 98% of those offenders having a history of substance abuse; all pregnant offenders are considered high-risk. The dental health of this patient population is exceptionally horrendous because of excessive drug abuse coupled with a sugary diet and poor oral hygiene practices. It is not uncommon for a 23-year-old to need all of her teeth extracted.

There are approximately 300 FTEs to include correctional staff that operate the facility and provide care to the offender population. The healthcare facility is comprised of the following directorates: (a) Medical, (b) Nursing, (c) Behavioral Health, (d) Pharmacy, (e) Dental, (f) Medical Records, (g) Health Service Support, and (h) Operations and Security.

Although the health care facility has a vast amount of capability, there limitations: (a) This facility does not have advanced cardiac life support capability (ACLS), (b) no surgical capability, (c) no ability to conduct telemetry, (d) no oral surgery beyond simple extractions, (e) no obstetrical capability beyond out-patient clinics, (f) MRI, (g) level 2 ultrasound, and the list goes on.

Those inmates who have medical needs that cannot be addressed by the health services staff at the correctional facility will need appointments with external health care providers who have a business relationship with the prisons in this area. On any given month, there will be approximately 300 offenders who will go to outside medical appointments and making certain that these appointments take place this is where the challenge lies. Similar to many health care operations, the prison Utilization Review / Case Management Department facilitates all external appointments and form the lynchpin between the correctional facility health care providers who refer offenders for specialty appointments, and the outside organization providing that appointment.  

Your assignment: You are the Case Coordinator. You have 300 patients that need to be scheduled for outside specialty appointments every month. You are tasked by the Administrator to develop a strategic plan organizing the out of the facility appointments without impairing internal services.

Takings in relation to environmental law can be defined as an act of the government acquiring property and compensating the previous owner justly. This is drawn from the fifth amendment of the United States constitution, which says “Nor shall private property be taken for public use without just compensation”. The government however has been seen to infringe on property owners rights by acquiring their land without any form of compensation. Such property may be used in the construction of roads or a military base (Malone, 2007).

Example of a legally resolved takings case

In the case of Dolan v. city of Tigard, 512 US.374 (1994) the court ruled that development permits must be roughly proportional to the effects the land in question will have to the community. In this case, the applicant sought to replace her hardware store with a larger facility and pave a 39 paving store. She was granted her wish but with conditions to it. The court however ruled in her favor stating that Dolan could not be forced to give up her land without just compensation. The land disputed formed part of wetlands that Tigard wanted to improve but had unfair conditions (Durant et al, 2004).

Effectiveness of NEPA

The national environmental policy act is a statute that requires all governments to integrate policy values into decision-making processes considering impacts of their proposed actions. (NEPA Homepage)This institution forces the state agencies to put in consideration the environmental factors in their decision making process but also empowers them to make informed decisions on the same. This was not in existence before (Malone, 2007).The environmental impact assessment is the heart of the implementation of the act. NEPA addresses the larger environmental problem, and has made a significant effort in addressing environmental issues. Its regulations have caused attitude and behavioral change thus leading to better agency decisions.

NEPA action forcing strategies to meet their goals have raised concerns and its critics ask if force will help attain quality in the environment. Critics of this act have a problem with the procedural emphasis. All projects must pass through some procedure to determine if they will have negative or positive impact on the environment. For this to be achieved several actions must be taken. The inability for the act to have requirements to guide implementation or abandon of the project is not agreeable with the critics (Anderson, 2009).

Success and failure of NEPA to prevent environmental harm

One of the victory stories is that of the construction of a parkway in Utah that would act as an alternative route to salt lake county. This project elicited several reactions from the public. This included a lawsuit filed by a coalition of environmental groups. After having gone to court, it was decided that all parties involved draft a way forward that will enable them to revise the initial plan. Thus, the idea of the parkway was conceived instead of a highway. The parkway is operational now (Environmental law institute et al, n.d). A recent failure by the environmental stakeholders is seen in the case of the deepwater horizon blowout. This case was looked into by engineers but continues to be a mystery to date. Questions raised by public on the environmental stakeholders’ role in this tragedy are yet to be answered. (Barstow et al, 2010)

Environmental laws can be procedural or substantive

NEPA has been seen to have both procedural and substantive laws that give direction on what is to be done. Procedural laws are set of rules that govern proceedings of the court in criminal lawsuits and administrative proceedings. Substantive law is a law that deals with the legal relationship with people and the state. The difference between the two is that procedural laws lay down the rules and enforces them while the substantive law defines the rights and duties of the people. (Meiners et al, 2012).An example of a substantive violation could be pollution of the atmosphere by dumping heavy metals and radioactive materials. This is a violation that infringes on the rights of people, and they have the duty to guard against this. Concerning procedural environmental law, the rights to public participation, access information, and access to justice are realistic ways to attain environmental protection and attain development .The procedural laws deal with structures already to pursue some form of justice.

NEPA has been instrumental in guarding against environmental degradation. However the action forcing law and lack of regulations need to be looked into, so that this policy can serve everyone in the nation. The NEPA officials need to step up and work diligently to avoid public outcry and injustices when dealing the environment.

I even contemplated taking the easy route of avoiding re-examining entirely, but actions would have prevented my learning and it would lead to perpetually bad choices. Thus, regardless of the pain, the critical examination engenders in me, I realize that it is important to reflect and evaluation of the actions.

According to Fabert (2003), a reflective action is different from individuals’ routine actions especially considering that various activities happen in one’s life. Reflection is typically compelling. Given that people learn by experience and from their past mistakes, reflection enables one to base his or her actions on such experiences and mistakes by mostly utilizing the best of the experiences while avoiding the mistakes. The process of reflection involves the need to engage in constant self-appraisal and development. Through the reflective process, I don’t only reflect on the principles of career choice but was also going through changes as I got the feedback of my earlier decisions. Coming from a background of engineering, this was the first time I was critically reflecting on my early career decisions and getting the feedback that was invaluable to the development of my career. In writing this critical reflection, Gibbs’s reflective cycle has been applied to systematically think about the different phases of my experience which will be indicated by the use of headings (Gibbs, 1988). I had struggled with the realization that some of my reflections were simply descriptions of the events that have taken place. The strength of this paper is that the reflection is based on what I can recall from memory and as a result, reflection writing provided me the opportunity to voice out my struggles and achievements. The change of career is something that I have continually wanted to improve upon.
