In the accomplishment of strategic objectives, scientific management puts the organization in competitive advantage through optimal use of resources and making informed decisions (Hoyle, 2006). From the text on top of the ad, thesis of the advertisement is “Consume our product” and the tenacity is to persuade the audience to visit Cannery Row.

Mothers are the audience whom this advertisement is intended for. The tactful image of a mother watching as her children play is a thing that women easily relates to. The transparency gives an impression that the woman is looking out through the window at her children inside a condo. The woman is evidently happy and smiling, and she is holding a cup of coffee. She also appears relaxed, and this implies that mothers can relax in Cannery Row and enjoy some time to themselves. Moreover, the advert aims at the upper class. In addition to her holding a cup of coffee, she is also in a pricey looking shirt, a gold watch, pearl earrings, and a large diamond ring. This, therefore, insinuates that Cannery Row is a vacation spot meant for the wealthy.

Children depicted playing on the beach are smiling and getting along well. Such happiness appears to be due to their surroundings, and they seem to be having a great moment at the beach and hence appeals to mothers concerned about the happiness of their children. The children are also preoccupied without the mother and hence, mothers can have time to themselves. The rhetorical question at the foot of the note asking when you ever watched your children play answered by the mother watching her children, indicating that Cannery Row is able to make that happen.

The ad also submits that Cannery Row is an exclusive place, or discreet and remote. From the picture, out on the water is clear, and the beach is clear of anyone else (Canneryrow.com). In essence, the family had that section of the beach all to themselves. However, a closer look at the sand betrays a ray of tracks and footsteps and almost nullifies the exclusivity depicted in the picture.

Another appealing aspect of the picture is the kids being alone on the beach. The mother will not have to worry about strangers and her children getting lost in crowds. The serene beaches seem to offer an escape from the chaotic city life and in the advert plays off with the emotion that most parents feel happy and at ease when their family is safe (Crouter and Head, 468). Cannery Row purports to offer this in the ad.

The photo depicts a tranquil sea, all blue, giving that impression that you cannot just sit in Cannery Row. It offers a getaway and even if there is nowhere written explicitly in the photo, character arrangement in the picture says it all. It is hard to determine whether the image is real, and there is a likelihood that it has been edited.

In essence, the advert is effective, and it makes an emotional appeal that mothers would find hard to resist. Such emotional connection as depicted in the picture with her children, a quest for tranquility, calmness and safety makes Cannery Row irresistible. The advert seems to target the upper-income folks who can afford such beach vacations. Lack of anyone else in the image also plays with the audience’s desire for exclusivity. There are two important sections in the Sarbanes-Oxley Act which are Section 302 which requires certification of the signing officers and Section 404 which mandates companies to publish their financial repors.

The Section 302 of Sarbanes Oxley

Section 302 of Sarbanes Oxley Act include certifications that signing officers have reviewed the report that it did not contain any false information either by omission or by misleading and that the financial statement fairly reflects the true financial condition of the company (www.soxlaw.com a, 2003). In addition, the signing officers must have also reviewed the internal controls of the company. Section 404 of Sarbanes-Oxley Act on the other hand mandates that issuers are required to publish their annual reports “concerning the scope and adequacy of the internal control structure and procedures for financial reporting. This statement shall also assess the effectiveness of such internal controls and procedures” (www.soxlaw.com b, 2003).

In the case of Apex Printing, they have only complied with the Section 404 of Sarbanes-Oxley Act which is the requirement to publish their annual reports and its attending internal control structure but it is not yet certified by signing officers that the financial information that they will publish is materially true and accurate. The importance of being compliant in the Section 302 is not only to avoid criminal liability from regulatory agencies such as Security of Exchange Commission but also to become an ethical company. It will hurt the reputation of the company which has numerous repercussions from not being able to do an IPO to source external funding to non-patronage of its products or services in the market due to the suspicion of its customers that the company is a fraud.

This paper validates that my research and understanding of the Section 302 of Sarbanes Oxley Act is correct. Especially when our interpretation is consistent that non-compliance with the Act has various repercussions such as the loss of credibility and criminal or civil prosecution from regulatory agencies. I expanded my interpretation however that the loss of credibility or the hurting of corporate reputation has an economic repercussion in the market as people will patronize the products and services of companies whom they doubt to have unethical practices such as non-compliance to regulatory agencies. This could hurt more than the criminal liability from the regulatory agencies because it undermines the viability of the business in the market.

In this paper, I learned that we both acknowledged that Sarbanes Oxley Act was crafted in response to the various corporate and accounting frauds that resulted in large number of people losing money and employees losing their jobs not to mention that it precipitated the global recession. In this paper, the criminal liability of the CEO and CEO for fraud is stressed. In my paper however, I did not entertain the idea of launching an IPO abroad just to avoid compliance with Section 302 of Sarbanes Oxley Act. Launching an IPO elsewhere to avoid regulations will surely be noticed by potential investors and will defeat the purpose of sourcing external funds because investors will not trust the company.
