Write an essay of 2,400 words based on two of the following questions:
QUESTION 1
Alice applied for a job with Marketing Services Ltd. She was interviewed, as also was Tom, who has similar qualifications and experience to her. Tom was given the job. Alice discovered that the
marketing department to which Tom was appointed, has only male employees. Alice is now arguing that she is a victim of sex discrimination.
Rose is employed in the personnel department. Harry, who also works in the department, has been with the company for the same length of time as Rose, but his pay is now one third higher, even
though they work the same hours. Rose has discovered this, and is arguing that she is entitled to the same pay.
Eva works as a secretary in the secretarial department. She has recently discovered that she only earns half the pay that Jack, who is a marketing assistant, earns in the marketing department. Eva
has a similar level of qualifications and experience. She is arguing that she is entitled to the same pay as Jack.
Amy, who works part-time in the personnel department has discovered that she cannot join the company pension scheme, which is only available to full-time employees. She has also found out that most
of the company’s part-time employees are female, and is arguing that she is a victim of sex discrimination.
Advise Alice, Rose, Eva and Amy on the basis whereby EU law on sex discrimination (Art 157 TFEU and Directive 2006/54) can be argued to the above events and critically assess whether each could be
successful in actions against the company for sex discrimination

Critically discuss the ways in which undertakings acting together can restrict or distort competition, and also how EU Law, under Article 101 TFEU, attempts to control this.
