DISCUSSION CASES: SEXUAL HARASSMENT
The “victim” in the following cases has come to you.

How would you respond?
Is this an “actionable” case of sexual harassment?
What can you do as a by-stander?
What “advice” would you give?

CASE ONE
Evelyn works in a steel mill. She recently transferred to a new department, which seems pretty “high-spirited” — lots of joking and socializing, including between team members, leaders and supervisors. Evelyn hangs out with a quieter crowd, but it’s impossible not to hear the jokes and continual cracks and comments. There’s a lot of back and forth about bodies and sex, about what did or didn’t happen the night before, etc. In addition there are nude pictures, mostly of women hanging around the department. There are some pin-up’s of the Chicago Bulls, however, none of them are nude pictures and no one has written nasty statements on them and drawn lewd pictures, like they have on the photos of women. Evelyn has asked a few of the men not to “bother her” with this stuff, but that has only made them “tease” her even more. Frustrated, Evelyn comes to you, the union representative in the next department. The union representative in her department told her that this talk is all good-natured and not really directed at anyone, and that if it bothers her, she should not listen to the conversations.
CASE TWO
Karen is a team leader who works in the mill. After several months of flirting with John, the team leader in the shipping department, the two decide to go out for dinner. They begin a relationship which lasts for several months, and includes everything from lunches at work to spending the weekend together fishing. Many of their co-workers thought the relationship was getting pretty serious.
After several months, Karen decides that she made a mistake, when she broke her personal rules of never dating someone from work. She decides that she does not want to see John socially any more, and she tries to explain her decision to him in a restaurant over dinner. John does not understand and does not want to give Karen up. At work he tries to get her to talk about why she no longer wants to see him. She tells him several times that she does not want to see him or discuss it anymore, but he persists. He seems to follow her around at work, calling her by the pet name he had used when they were dating. John talks to others at work about Karen as if they were still dating, sometimes critical about the way she is doing her job. Reluctantly, Karen reports these incidents to someone in the personnel office who promptly fires John, stating that the company takes the issue of sexual harassment very seriously. John comes to you, demanding that the union get his job back!!

CASE THREE
Jane Jones obtains a job as a heavy equipment operator, a job that has not been held by a woman before. On several occasions one co-worker has stated to other men in the department, in Jane’s presence,that he does not believe women are capable of performing Jane’s job. Cartoons have been posted making fun of women drivers. Jane’s co-workers have been openly critical of her work performance and directed her to the dirtiest and least desirable work assignments. When Jane asks questions regarding her job, some of the men ignore her and others act put out, saying for instance, “Don’t you know that yet?” Jane does not believe that she has received the same level of training that other newcomers in her job have received. Jane goes to the foreman to complain, but he responds that all new employees in the department go through the same thing. He says the comments and actions she has experienced are normal.
