Workplace Safety Case

An employee works at home part of each work week, primarily performing data entry tasks. One day the employee was carrying a large file folder of forms from his car into his house and was going to his home office to work. However, he stumbled on one of his child’s toys lying on the driveway and fell. He sprained his right hand and was unable to perform any work either at home or the workplace office for seven work days. The employee feels that the incident is work-related, but the employer is not sure. While the employee is injured at home doing work stuff was it the work that caused the injury?

Case Question (Privity & Capacity)
While John and Mary were away in Thailand for a vacation, James, their 17 year old son decided to go on a frolic of his own. He went to CustomMade Tailor and made an order of five top grade Egyptian silk shirts and five premium cashmere wool trousers. Although the items amounted to a whopping $4,000, James managed to talk the owner into letting him pay a deposit of $100 for the clothes, and to pay the remaining sum two weeks later. James also signed up for online one-to-one coaching sessions via webcam with a top American ‘Left4Dead’ professional gamer, Mr Lauren. James’s dream was to be a professional Left4Dead gamer himself, which he heard was a potentially lucrative profession. Although James signed up for a package of 30 coaching sessions amounting to $3,000 in total, he managed to negotiate for payment to be made on the second lesson instead.
When John and Mary returned, James asked them for money to pay the outstanding $3,900 for the tailored clothes which were due for collection the next day. Mary screamed at James and asked why he needed such expensive clothes. James defiantly retorted that he needed these clothes as he had to dress well for his upcoming internship with GameVid Entertainment (a company specializing in the development of video games) in America. James also asked John and Mary for $3,000 to pay for his Left4Dead coaching sessions as he was having his second lesson later that week.
