Case Study: The Role of the Forensic Psychology Professional in Capital Punishment Sentencing

Mr. Fryer has a long history of psychiatric hospitalizations related to his diagnosis of paranoid schizophrenia. His delusions revolve around the belief in uniformed spies who have been sent to execute him. He reports auditory and visual hallucinations when not on his medication. He was arrested for trespassing after he was found sleeping in the delivery shed of a warehouse.

During his stay in jail, he was put on antipsychotic medications, and he was released with time served after spending fifty-four days in the jail. Upon his release, he returned to live on the streets and stopped taking his medications. While sleeping on a park’s bench, he was assaulted by several youths, who hit and kicked him. Although his assailants left him on the ground with no serious injuries, Mr. Fryer was convinced that the juveniles who assaulted him were spies who would return to assassinate him.

He found a seventeen-inch pipe to use as a defensive weapon, and, fearing for his life, he hid in the shadows the remainder of the evening. In the morning, he saw two uniformed youths approaching him. A twelve-year-old boy and his fourteen-year-old brother were on their way to a Boy Scout meeting. Mr. Fryer ran up behind the boys and started swinging the pipe wildly, screaming they would never take him alive. He struck the twelve-year-old boy on the head, causing him severe brain trauma. The fourteen-year-old boy was able to flee but only after receiving a blow on the face. Mr. Fryer returned to the twelve-year-old boy and bludgeoned him to death.

He was still hitting the lifeless body when the police arrived. As soon as the police car pulled up, he dropped the pipe and sat in silence as he was subdued. He was determined by the court to be not competent to stand trial and was committed to a state hospital for restoration of competence. After eight months of pharmacological treatment, he was determined by the court to be competent to stand trial and was subsequently tried and convicted of capital murder.

The following are the mitigating circumstances in this case:

  • At the time of the offense, Mr. Fryer was under extreme emotional and mental distress.
  • At the time of the offense, Mr. Fryer was substantially unable to appreciate the wrongfulness of his act or conform his actions to the requirements of the law.

The following are the aggravating circumstances in this case:

  • The crime was committed in a wanton, atrocious, and cruel manner.
  • Mr. Fryer is likely to commit criminal acts in the future.

Choices are the name of the game this time around. Pick one of the following choices to write a 4-6 page essay on. Label your essay according to the choice you make (ex. 2A), or there will be a 1 point deduction on your essay.

For any of these essays, you must refer to at least two of our assigned readings in a way that illustrates both your understanding of the text as a whole and your ability to apply the reading to the films discussed. Throwing in quotes doesn’t do this. Readings chosen must be appropriate to the topic you choose (ex. if writing about gender, the readings you choose should be about gender). The readings must be from among our scholarly texts, ex. the chapters OR academic essays assigned on the syllabus rather than one of the shorter, more popular, and less academic essays. If unsure about your selection, please ask. Choose from films after week 4 as well.

Essays will be graded according to: quality of writing, strength of thesis, completion of the question, and displayed knowledge/understanding of class lectures, reading, and viewing. If you have a very focused argument, you may be able to do a comparison/contrast between two films; you should discuss this with me.

2A Discuss the treatment of gender in one of our films, coming up with an argument to make about it.

2B Discuss the treatment of sexuality in one of our films, coming up with an argument to make about it.

2C Considering our discussions of authenticity in class (re: The Crying Game, Ghost in the Shell, Moana), formulate an argument about the representation of race, nation, gender, or sexuality in your chosen film from our class.

2D Discuss the construction of identity or humanity in one of our films.

2E Propose another idea to Dr. B.; it must be proposed and accepted in order to complete this choice and get credit for it.

Cinematography has not been the focus of most of our discussions, but if you have some background in how to “read” a film, you certainly may want to discuss visual as well as narrative elements.

Look through Part II of Voyages to find details about your characters life. Think about how he or she would answer each question. Write your answer using the first person.

First: Watch the Video lecture for Voyages Part II, and read Voyages Part II. Choose a character and use your character’s name as the first line of your post (like a title). (Hit reply to my thread). (There are 9 possible characters to choose from. Only 5 people can pick each character. So, make sure to read through the posts and pick a character who has fewer than 5 threads.

Second: Answer each question from your characters point of view. Use specific details from the book. You can use quotes, but put the events in your own words. Write at least 1 paragraph per question. (Question 5 can be one sentence each)

Third: For question 5, write two discussion questions you want to ask two particular characters (or all the characters in general).

Fourth: After you finish your post, read through other peoples posts and respond to at least 2 peoples posts and questions. You can answer questions for any character, it doesnt just have to be the one you chose for your original thread. Write at least 1 paragraph per answer.

Characters to choose from: Seini, Eseta, Manu, Malia, Atu, Finau, Palu (Emma), Vei, Lio Jr.

Answer these Questions from your character’s perspective:

Give a brief introduction of you, your family and your life. What is the most important experience you have had in your life and why?

Tell us about what your home looks like and what your home means to you. In this you could describe the significance of the design, rooms, decorations, how it was built, who lives there, where it is, etc. How does this home differ from the places where other people in your family (or village) live?

Do you feel Tongan, American, Tongan American or something else and why? Has this changed over time? How do you feel that migration has impacted your family, your life and culture?

How do you feel about being interviewed by Cathy Small and being part of her book? Do you feel that Cathy is part of your family, why or why not? What do you think is the value of participating in an anthropological study like this one? Were there any negative aspects of participating in her study? Do you think Cathy Small is writing from a humanistic or social science perspective?

Look at the list of characters. Choose two characters and write questions for them. These questions should be from your characters point of view. Think about people your character might have a special relationship, argument or issue with. For example, Vei might ask Emma what she thinks her life would have been like if she had stayed in Tonga instead of migrated, etc.
