Before you start on this week’s part of the project, you learn more facts about the negotiation of this contract:

Bob decides that he wants the toys and calls you to set up a meeting  to discuss the price and to examine the collection of toys to make sure  they are in excellent shape.

On October 4th, you meet at a local restaurant whereupon Bob examines  the toys, which are up to his standards. You offer to sell them to him  for $750.00. Bob scoffs and offers $650.00. Although you are a bit  frustrated with his counteroffer, you remember that you really need the  money so you offer $725.00. Bob grumbles and increases his offer by a  mere $10 to $660.00. He claims he will not pay a penny more. You lower  your price to $720.00 and inform him that this is your best, final  offer.

Bob states that he will not pay that price and departs the  restaurant. Feeling defeated you collect your toys and go home. As you  walk home, you wonder if you should have continued the negotiation and  gone lower seeing that $700 is your goal price.

On October 13th, you get a call from Bob. It turns out that he combed  the entire Internet and can’t seem to find a set that is complete like  the one you are offering. Sounding a little bashful, Bob offers to pay  you $700.00 for the set. Just to toy with Bob a bit, you provide a price  of $710.00. After hesitating for a few moment, Bob accepts.

You mutually agree that you will meet at noon on October 17th back at  the restaurant that you met the previous week. You make a stipulation  that you want payment to be in cash, particularly smaller bills.

Earlier you were introduced to the overview of the project for this  course. For this week you will start on your way to drafting a contract  for this situation by filling in the worksheet that appears as an  attachment below. You will need to open the attachment and save it to  your files. 

You will fill in the worksheet and answer the questions that  follow the chart.

Your course project is to develop an Anti-Bias Action Plan. For this part of the project, you will select and research a diverse group in your community that has experienced inequality, bias, or discrimination in the past. You will then gather background information about the group, and then submit a report of your findings.

Step 1: Select and research a diverse group in your community that has experienced inequality, bias, or discrimination in the past. Your focus should be on children ages birth through 8 years old in the selected group.

Considerations for selecting your group:

  • Examples include a cultural group you are interested in or concerned about, a specific language group whose linguistic needs are not being met, children with special needs, a diverse religious or socioeconomic group, a gender/sexual orientation group, and so on.

Step 2: Gather background information about the selected diverse group.

  • Research and learn more about the diverse group of learners you selected and the group’s experiences with discrimination and bias.
  • Incorporate two (2) credible resources to examine and compare relevant facts and information about the group you selected. You can use your textbook, credible websites, articles, etc. One must be a resource located through the Rasmussen Library databases.

Step 3: Report your findings in a 2-3 page paper.

  • Identify the group you selected and explain why and/or how you selected the group.
  • Describe the group and the form of discrimination it has endured, both in the past and currently.
  • Describe what type of action (if any) it has taken in the past.
  • Integrate the facts and information you gathered from your resources to better explain the groups experiences with discrimination and bias.

Module 02 Written Assignment – For Your Consideration

 

Throughout this module you learned the basics of contract formation.  An additional requirement of contract formation is consideration. The  courts separate legally binding obligations from mere agreements by  checking for consideration. Under basic principles of contract law,  consideration is the answer to the question, “Why are you entering this  contract?” or “What are you receiving for being a party to this  contract?”

Consideration, quite simply, is the benefit that each party gets or  expects to get from the contractual deal. For example, you paid your  college tuition money for an education. You benefit by receiving the  educational services of the college, and the college benefits by  receiving your tuition money.

For this written assignment, you will further explore the topic of  consideration and whether it is present in the following scenarios. Read  the facts of the scenario and answer the following questions:

  1. Is there proper consideration? (Further research on consideration is recommended)
  2. Why or why not is there valid consideration? 

Your answer to each scenario should be a paragraph in length and must  include the source of your information in a properly formatted APA  citation.

Scenario 1:

Tasha rents an apartment in an undesirable part of town. While  others, such as her Aunt Rita, find it unsuitable, Tasha seems fine with  her living situation. She never experiences any problems with the  neighbors, and the rent is cheap. One day during a phone call, Aunt Rita  tells her that she wants to gift her $10,000 for anything of her  choosing. Tasha figures that this is her aunt’s backhanded way of  getting her to move, so she decides to search for a home. Upon finding a  home, Tasha calls her Aunt Rita and asks for the money. Rita changes  her mind and tells Tasha that she no longer wants to give her the money.  Angrily, Tasha hangs up the phone and heads to the courthouse to sue  her aunt for the $10,000. Is there consideration?

Scenario 2:

Officer Friendly notices a poster announcing that a reward is being  offered for the capture of a nefarious criminal, Fred Doesnogood. During  his evening patrol, Officer Friendly apprehends and arrests Doesnogood.  After he completes his shift he decides to call the number to get the  reward seeing as he is the one who captured him. Will he be able to get  the reward? Is there consideration? 

Scenario 3:
 

 Ezra loves watching home improvement shows, but is not that handy when  it comes to doing the actual improvements at his house. During one of  his favorite shows, an ad appears for a local painting company that is  running a fantastic deal. He calls the number and arranges for Izzy to  paint his house on Friday. Izzy shows up on Friday and they agree upon a  price of $700.00 for the exterior of the house to be painted. Izzy  completes the job to the satisfaction of Ezra, but he does not seem to  want to pay. Is there consideration?
